ACCEPTANCE OF THESE TERMS
By accessing, browsing, or using the Best of Backyard LLC website or websites, creating an account, or placing an order online, In-store or over the phone, you agree to be bound by these Terms of Use (the “Terms”) and all policies incorporated by reference, including our Privacy Policy (https://bestofbackyard.com/privacy-policy/) and Shipping & Returns policy (https://bestofbackyard.com/shipping-returns/).
If you do not agree, do not use the Site.
CHANGES TO THE TERMS AND THE SITE
We may update the Terms or the Site at any time. Changes are effective when posted. Your continued use of the Site means you accept the updated Terms.
ELIGIBILITY & ACCOUNT RESPONSIBILITIES
Age requirement. You must be at least 18 years old (or the age of majority where you live) to use the Site and place orders. The Site is not intended for minors.
• Your information. You agree to provide accurate, current, and complete information (including name, email, phone, billing and shipping addresses) and to keep it updated so we can process orders and reach you about deliveries or support.
• Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Use a strong, unique password and, where available, enable multi-factor authentication. Secure your devices and sign out on shared computers.
• Unauthorized use. Notify us promptly if you suspect unauthorized access or activity on your account. Until you notify us and we are able to secure the account, you are responsible for activity occurring under your credentials. Orders submitted before we receive notice may be processed.
OWNERSHIP & INTELLECTUAL PROPERTY
All content on the Site—including its design, selection and arrangement, text, graphics, product images, videos, icons, software, and other materials—is owned by Best of Backyard LLC and its partners & licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
No unauthorized use. You may not copy, reproduce, distribute, modify, adapt, translate, reverse engineer, scrape, frame/mirror, or create derivative works from any Site content, nor use our trademarks or trade dress, without prior written permission.

UNACCEPTABLE USE OF OUR WEBSITE
Use the Site responsibly and only for lawful, legitimate purposes. You agree not to:
• Break the law or harm others. No illegal, harmful, deceptive, or fraudulent activity; no exploitation or harm to minors.

• Abuse promotions or accounts. Don’t “double-dip,” brute-force coupons, create multiple accounts to evade limits, or manipulate reviews/ratings.
• Violate privacy. Don’t collect, store, or publish others’ personal information without consent.
• Misuse intellectual property. Don’t copy, reproduce, mirror, frame, or create derivative works from Site content or trademarks without written permission.
• Resell or commercialize without approval. Don’t use the Site to run a competing service, bulk-purchase for unauthorized resale, or otherwise use it beyond the scope of our license to you.
• Violate export or sanctions rules. Comply with applicable export, sanctions, and trade laws.
Enforcement & remedies. We may monitor for abuse and may, at our discretion and without notice, suspend or terminate access, cancel orders, remove content, throttle or block traffic, report suspected violations to law enforcement, and seek legal and equitable remedies (including injunctive relief and damages).

PRODUCT INFORMATION, AVAILABILITY & PRICING

Accuracy & images. We work hard to keep product descriptions, images, specifications, pricing, and availability accurate, but errors may occur. Content is provided “as is” and may change without notice. Photos are illustrative; colors/finishes can vary due to screens, lighting, or manufacturer updates. Dimensions and weights may include normal tolerances. Unless stated, accessories, installation, and decorative items are not included.

Manufacturer changes. Makers may change specs, components, packaging, or model numbers without our knowledge. We may update listings or substitute a current equivalent as provided by the manufacturer.

Availability is not guaranteed. Stock, “in-stock,” “ships in,” and delivery estimates are estimates, not guarantees. Inventory can change after you place an order, especially for drop-ship/freight items. We may ship items separately, offer alternatives, place items on backorder, or cancel any portion we cannot supply.

Right to limit or refuse orders. We may limit quantities per person/household/order and refuse or cancel orders (including after submission) for suspected fraud/misuse, pricing or listing errors, or supply issues. If we cancel after payment capture, we’ll refund the amount paid.

Pricing. All prices are in U.S. dollars unless stated and exclude taxes, shipping, freight surcharges, lift-gate/appointment fees, and installation. Prices, promotions, and offers may change at any time without notice and may be limited to “while supplies last.” Free gifts/BOGO are subject to availability and may be substituted.

Misprints & errors. If a product is listed at an incorrect price or with incorrect information, we are not obligated to honor it. We may cancel the order and notify you or seek your approval at the corrected price; if charged, we will promptly refund.

Promotions & MAP brand exclusions. Only one promotion/code per order; no stacking. Promo codes generally do not apply to items already on sale/clearance or to certain MAP-restricted brands (including, for example, Twin Eagles, Delta Heat, Mont Alpi, Napoleon, and other restricted brands).
ORDERS, PROMOTIONS & COUPONS
Order acceptance & verification. Your order is an offer to buy. We may accept, decline, or cancel any order at our discretion (including after submission) for reasons such as verification issues, availability, pricing/listing errors, or suspected misuse/fraud. We may limit quantities per person, household, or order and may contact you for additional verification on high-value or freight shipments.
Payment authorization. Submitting an order authorizes us to obtain payment approval and, upon acceptance, to charge your selected method for merchandise, taxes, shipping, and any applicable fees.
Title & risk of loss. Title and risk of loss transfer to you when we hand the order to the carrier. For freight/LTL deliveries, an adult must be available at the scheduled time. Availability, backorders & split shipments. Availability and ship dates are estimates, not guarantees. We may ship items separately, place items on backorder, suggest alternatives, or cancel items we cannot supply. If we cancel after capturing payment, we’ll refund the amount paid for the cancelled item(s).
Cancellations & changes. Once an order is released to the warehouse, 3PL, or manufacturer, changes/cancellations may not be possible. Address changes after shipment may incur carrier fees. Refused deliveries may be subject to return freight and restocking under our Shipping & Returns policy.
Pricing & errors. Prices are in U.S. dollars and exclude taxes, shipping, freight surcharges, lift-gate/appointment fees, installation, and similar charges unless stated. Post-purchase price changes. If our price drops after you buy, we do not offer price adjustments or retroactive discounts.
PROMOTIONS & COUPONS
One promotion per order. Only one promotion/discount code may be applied per order—no stacking or “double-dipping.”
What promos apply to. Unless stated otherwise, discounts apply to the merchandise subtotal and exclude taxes, shipping, freight/oversize fees, services, and gift cards.
Not valid on sale/clearance/bundles. Promo codes generally do not apply to items already on sale or clearance, or to special bundle pricing.
Brand exclusions (MAP). Certain brands are excluded due to Minimum Advertised Price (MAP) policies (e.g., Twin Eagles, Delta Heat, Mont Alpi, Napoleon, and other MAP-restricted brands).
BOGO & Free Gifts. If a promotion requires qualifying items/thresholds, the free/bonus item may be auto-added at checkout or fulfilled by our team. If qualifications are not met (including after a return), the bonus item will be removed or charged at its current price. Offers are while supplies last and substitutions may be made.
No cash value; not retroactive. Promotions have no cash value, are not transferable, and do not apply to past orders.
Misuse & abuse. We may reject, limit, or cancel orders involving coupon abuse (e.g., multiple accounts, automated use, brute-forcing codes) or inconsistent with offer terms.
Changes. Promotions, thresholds, and eligible items may change or end at any time without notice.
PRICE MATCH POLICY
We want you to get the best deal. If you find an identical item at a lower delivered price from a qualifying U.S. retailer, we’ll work to match it before you purchase.
Eligibility (what we match—pre-purchase only)
• Same item: New, identical brand/model/UPC and configuration (size, finish, fuel type), same warranty.
• In stock: Competitor has the item in stock and able to ship to your address.
• Authorized U.S. retailers: No marketplaces/third-party sellers, auctions, membership clubs requiring paid access, installers, or grey-market sellers.
• Verifiable price: Publicly advertised price we can confirm via a direct link (screenshots may be requested).
• Delivered cost: We compare total delivered price (item price + required shipping/handling/delivery fees). Taxes are excluded due to state variations.
Not combinable. A price match cannot be combined with our promotions or coupons; we’ll apply whichever single option yields the better final price.
Post-purchase note. We do not provide price matches or price adjustments after a purchase is completed (including if our price goes on sale later).

SHIPPING, RETURNS, WARRANTY & SERVICES
Shipping & delivery. Shipping methods, delivery windows, freight appointments, damage/shortage claims, and refused shipments are governed by our posted policy: https://bestofbackyard.com/shipping-returns/. Delivery timelines are estimates and may vary by carrier, location, weather, and product availability. For freight/LTL deliveries, an adult must be present; inspect packages at delivery and note any visible damage with the driver.
Returns & exchanges — 30 days. We accept returns within 30 days of delivery (RMA required). Items must be new, unused, and in original packaging with all accessories and manuals. Some items may be non-returnable (e.g., installed/used goods, made-to-order/custom items, clearance/final sale) and returns may be subject to freight and restocking fees. Warranty coverage & claims. All products are covered under the manufacturer’s warranty and are administered under the manufacturer’s terms. Best of Backyard does not determine approval decisions, the speed of claim handling, or when replacement parts/items are shipped. We provide assistance and coordination only. Have your order number, serial number (if applicable), photos/video of the issue, and proof of installation per the manufacturer’s requirements. (Labor/installation and wear-and-tear are typically excluded—see the manufacturer’s warranty for specifics.)
Services & installation. Optional services (e.g., installation, assembly, custom work, white-glove delivery) may carry separate terms, pricing, and scheduling. Any third-party installers or delivery crews are independent contractors, not employees or agents of Best of Backyard. Their policies and warranties apply to their work. You are responsible for permits, inspections, and compliance with local codes.
USER CONTENT (REVIEWS, PHOTOS, SUBMISSIONS)
By submitting or making content available through the Site or our channels, you grant Best of Backyard LLC (and our affiliates and service providers) a worldwide, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, host, store, reproduce, modify, adapt, translate, publish, distribute, publicly display, publicly perform, and create derivative works of your content in any media now known or later developed for operational, analytical, and marketing purposes (including on our website, emails, ads, social media, and in-store materials). You also grant us permission to use your name/username, city, likeness, and testimonials in connection with that content, as permitted by law.
No compensation. Unless we agree in writing, you will not receive payment for content you submit. We may request proof of purchase to mark reviews as “verified.”
Claims about content. We do not endorse user content and are not liable for it.
INFORMATION ON WEBSITE
The content on our Site (including guides, FAQs, sizing tools, and recommendations) is general information only. It is not professional advice and is not a substitute for work performed by licensed trades. We do not provide engineering, architectural, gas-fitting, electrical, or safety certifications, and we do not guarantee code compliance.
Important about accuracy & updates. Our FAQs and guides may contain outdated or incomplete information (for example, changes to product specs, model numbers, or codes). We may update content at any time without notice, but we have no obligation to keep every page current. Manufacturer manuals and local codes control if there is any conflict with Site content.
DISCLAIMERS
INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Best of Backyard LLC and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your content, or your violation of these Terms or applicable law.
LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, BEST OF BACKYARD LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUPPLIERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR COSTS OF SUBSTITUTE GOODS OR SERVICES ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, PRODUCTS, OR SERVICES—EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
PRODUCTS & THIRD PARTIES. TOTAL CAP. OUR AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID TO US FOR THE TRANSACTION GIVING RISE TO THE CLAIM.
SCOPE & EXCEPTIONS. These limits apply regardless of theory (contract, tort—including negligence—strict liability, statute, or otherwise) and even if any limited remedy fails of its essential purpose. GOVERNING LAW; DISPUTE RESOLUTION (ARBITRATION, FEES, PUBLIC-INJUNCTIVE RELIEF)

Governing law. These Terms and any dispute with Best of Backyard LLC are governed by the laws of the State of California, without regard to conflict-of-law principles.

Informal resolution. Before filing a claim, email info@bestofbackyard.com with a summary of the dispute so we can try to resolve it in good faith (up to 60 days).

Federal Arbitration Act. This section is governed by the Federal Arbitration Act (9 U.S.C. §1 et seq.), except as limited by non-waivable California consumer protections (including the McGill rule on public-injunctive relief).

Binding individual arbitration (consumer rules). Except for (i) small-claims matters and (ii) claims seeking public injunctive relief under California law, any dispute arising out of or relating to these Terms, our Site, products, or Services will be resolved by binding, individual arbitration administered by the AAA (Consumer Arbitration Rules) or JAMS (Consumer Minimum Standards)—at your election—before a single neutral arbitrator. Hearings may be by video/phone or, if in person, in the California county of your residence (unless we agree otherwise).

Waivers. YOU AND BEST OF BACKYARD LLC WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. (This does not waive your right to seek public injunctive relief in court where required by California law.)

Fees & costs (consumer protections). Your filing fee is limited to the forum’s consumer filing fee; we pay the remaining administrative and arbitrator fees as required by AAA/JAMS consumer rules. Each side bears its own attorneys’ fees unless a statute or contract provides otherwise. You will not be liable for the other side’s fees/costs if you do not prevail where prohibited by California law.

Opt-out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing info@bestofbackyard.com or mailing 9901 Indiana Ave Unit 109, Riverside, CA 92503 with your name, address, and a clear statement that you opt out of arbitration.

Venue if not arbitrated. If you opt out, or if the arbitration agreement is unenforceable as to a claim, that claim shall be brought exclusively in the state or federal courts in Riverside County, California, and the parties consent to jurisdiction and venue there.

Severability & survival. If the class-action waiver is held unenforceable as to a particular claim, that claim proceeds in court, while any remaining claims proceed in arbitration. If any other provision is unlawful, it is severed and the remainder remains in force. This section survives termination of the Terms and your relationship with us.

Our Site and Services are directed to U.S. residents and U.S. delivery addresses only. We do not offer international sales or shipping.

Orders & access. We may cancel any order with a non-U.S. billing/shipping address, payment instrument, freight-forwarding destination, or non-U.S. IP indicators, and we may block or restrict access from locations outside the U.S.

TERMINATION
SEVERABILITY & ENTIRE AGREEMENT
If any provision is found unenforceable, the remaining provisions will remain in full force.
