Information We Collect

We collect information in three main ways: (1) you give it to us, (2) it’s collected automatically when you use our site, and (3) we receive it from trusted partners. We may combine information from these sources to run our business and improve your experience.

1) Information You Provide

  • Contact & identifiers: name, email address, phone number.

  • Order & delivery details: items purchased, billing and shipping addresses, order notes, delivery preferences.

  • Payment details: submitted to our PCI-DSS compliant payment processors to authorize and settle transactions. We do not store full card numbers on our systems. We may keep limited transaction data (e.g., last four digits, authorization codes) for receipts, fraud prevention, and compliance.

  • Account information: login credentials, saved addresses, wish lists or favorites, communication preferences.

  • Customer service & communications: emails, chats, support tickets, survey responses, product Q&A, and reviews you post (including any photos/content you upload).

  • Promotions & programs: entries for giveaways, coupons, or referral programs; your preferences for marketing (email/SMS opt-ins).

  • Showroom & events (if you visit): appointment/scheduling details; where posted, we may use CCTV for security and loss prevention.

2) Information Collected Automatically

  • Device & usage data: IP address, device and browser type, operating system, date/time stamps, pages viewed, time on page, clicks/scrolls, and referring/exit pages.

  • Approximate location: inferred from your IP address to support fraud prevention, shipping estimates, and localized content.

  • Logs & diagnostics: error logs and performance data to keep the site reliable and secure.

  • Cookies & similar technologies: cookies, pixels, tags, and web beacons that help us (a) enable cart/checkout and authentication, (b) remember preferences, (c) analyze performance, and (d) measure advertising effectiveness. You can manage cookies in your browser settings. Where available, we honor Global Privacy Control (GPC) signals as an opt-out of “sale” or “sharing” under applicable state laws.

3) Information From Third Parties

  • Operational partners: payment processors, fraud-screening and identity-verification tools, shipping carriers/fulfillment centers, returns/RMA processors (status updates, delivery details, and signals to prevent fraud).

  • Analytics & advertising partners: aggregated or device-level insights that help us understand site usage and measure/optimize campaigns (subject to your choices and applicable laws).

  • Manufacturers & service providers (at your request): product registration, warranty claims, recall processing, installer referrals.

  • Financing/insurance (optional): if you apply for financing or purchase protection/insurance, we receive information needed to provide those services (their privacy policies apply).

  • Public sources & social media: information you make available when you interact with our social pages or public content.

4) Categories for State Privacy Laws (Summary)

  • Identifiers (e.g., name, email, phone, IP).

  • Customer records (e.g., billing/shipping addresses).

  • Commercial information (e.g., products viewed/purchased, order history).

  • Internet/network activity (e.g., interactions with our site and ads).

  • Approximate geolocation (from IP).

  • Inferences drawn from the above to improve products, content, and offers.
We do not seek to collect sensitive personal information (e.g., government IDs, precise geolocation, health data), and we do not store full payment card numbers.

How We Use Information

We use the information we collect to operate our business, fulfill your requests, and improve your experience. Specifically, we use it to:

Order handling and account services

  • Process and fulfill orders, arrange shipping and delivery, handle returns, exchanges, and warranties (see Shipping & Returns: https://bestofbackyard.com/shipping-returns/).

  • Create and manage your account, remember preferences, saved addresses, and recently viewed items.

  • Provide invoices, receipts, order confirmations, delivery updates, and service notifications.

Customer support and communications

  • Respond to questions, troubleshoot issues, and provide tailored customer support by email, phone, or chat.

  • Collect feedback through reviews, surveys, and Q&A to improve our products and service.

Personalization and experience

  • Recommend products, sizes, and compatible accessories based on your activity and preferences.

  • Remember cart contents, language, and display settings to make your next visit faster and easier.

Site operations, analytics, and improvement

  • Operate, maintain, and secure our website and systems.

  • Analyze site usage (pages visited, features used) to fix bugs, improve navigation, and guide product decisions.

  • Measure the effectiveness of promotions, content, and website features, often using aggregated or de-identified data.

Marketing and promotions (with your choices)

  • Send newsletters, offers, and product announcements if you’ve opted in; you can unsubscribe at any time.

  • Perform advertising measurement and frequency capping; where required, we rely on your consent and honor Global Privacy Control (GPC) signals for opt-out of “sale” or “sharing.”

Security, fraud prevention, and compliance

  • Authenticate users, detect and prevent fraud, abuse, and unauthorized transactions.

  • Enforce our Terms of Use (https://bestofbackyard.com/terms-of-use/), protect our rights and the safety of customers, and comply with legal, tax, and regulatory obligations.

Order-related partners you choose to use

  • Register products or process warranty claims with manufacturers at your request.

  • Facilitate installer referrals, financing, protection plans, and shipping insurance if you opt to use those services (their privacy policies apply).

Business continuity and legal needs

  • Keep appropriate records for accounting, audits, and tax purposes.

  • Prepare for and execute a business transfer (merger, acquisition, or asset sale); if ownership changes, we will continue to protect your information or provide notice of material changes and your options.

Research and development

  • Use aggregated, de-identified, or pseudonymized information to understand trends and improve product quality, packaging, shipping processes, and customer experience.

PAYMENT PROCESSING

  • Secure partners: We process payments through Stripe and PayPal, using TLS/SSL encryption. Both are PCI DSS–compliant.

  • What we share: Only what’s needed to complete payment (name, contact info, billing/shipping address, order total). The processors handle your full card details.

  • What we don’t store: We don’t store full card numbers or CVV. We may keep tokenized references and limited metadata (e.g., last four digits) for receipts and refunds.

  • Fraud protection: Our processors use AVS, CVV checks, risk scoring, and (where supported) 3-D Secure to help stop unauthorized use.

  • Refunds: Issued to the original payment method via Stripe or PayPal. Your bank/PayPal controls when funds appear.

  • Your choices: Pay by card (Stripe) or with PayPal. You can ask us to remove any saved payment token.

  • Disputes: If you see an unexpected charge, contact us first so we can investigate and resolve it quickly.

COOKIES & TRACKING TECHNOLOGIES

We use:
• Strictly necessary cookies (cart, checkout, authentication).
• Functional cookies (remember settings).
• Performance/analytics cookies (traffic stats, diagnostics).
• Advertising/retargeting cookies (frequency capping, ad measurement).

Your choices: Most browsers let you block or delete cookies. Some features will not work without them. Where available, we honor the Global Privacy Control (GPC) signal as an opt-out of “sale” or “sharing” under applicable state laws. “Do Not Track” (DNT) is not standardized; we treat GPC as the applicable signal.

DATA SECURITY

  • Encryption: We use TLS/SSL to protect data in transit. Sensitive payment details are handled by PCI-compliant processors (e.g., Stripe/PayPal) and tokenized; we do not store full card numbers or CVV.

  • Access controls: Role-based, least-privilege access with authentication safeguards (including MFA on internal systems) and session/time-out controls.

  • Infrastructure protection: Firewalls, WAF/DDoS protection, network segmentation, and hardened configurations on reputable cloud hosting.

  • Monitoring & fraud prevention: Logging, anomaly detection, and risk scoring to spot abuse, account takeover, and payment fraud.

  • Vulnerability management: Regular patching, dependency updates, vulnerability scans, and periodic security reviews of code and systems.

  • Vendor oversight: Contracts require service providers to protect data and use it only to deliver their services to us; we review their security posture.

  • Backups & continuity: Encrypted backups and tested recovery procedures to help safeguard availability and integrity.

  • Data minimization & retention: We collect what we need, keep it only as long as necessary (see Data Retention), then delete or de-identify it.

  • Incident response: We investigate suspected incidents and, where required by law, notify affected users and regulators.

  • Your part: Use strong, unique passwords; protect devices; and watch for phishing. If you suspect unauthorized activity, contact info@bestofbackyard.com or (888) 731-2629 immediately.

No method of transmission or storage is 100% secure, but we regularly review and improve our safeguards to reduce risk.

DATA RETENTION

We retain personal information only as long as needed for the purposes in this Policy or as required by law. Typical examples:
• Orders/invoices: up to 7 years (tax, accounting, warranty).
• Customer service records: 2–4 years after last interaction.
• Marketing preferences and email logs: until you opt out or your account becomes inactive, then archived or deleted.
• Analytics data: commonly 18–26 months, often aggregated.
• Reviews/photos: until removed by you or us or as needed for legal/compliance.
When data is no longer needed, we delete or de-identify it.

BUSINESS TRANSFERS & CHANGE OF CONTROL

What happens if we sell or reorganize the business. If Best of Backyard LLC is involved in a merger, acquisition, asset sale, joint venture, financing, bankruptcy, reorganization, or similar transaction, personal information we have collected (for example, account details, order history, contact information, and customer service records) may be transferred as part of that transaction. The acquiring or successor entity will assume the rights and obligations described in this Privacy Policy.

What is not transferred. We do not store full payment card numbers on our systems; payments are processed by PCI-compliant processors. Because we do not hold full card numbers, we do not transfer them in a sale.

Successor’s obligations. Any successor must protect your personal information at least to the same standard described here or provide you with a notice describing any material changes and your choices.

Your choices if ownership changes. You may:

  • request access, correction, or deletion of your personal information;

  • opt out of marketing from the new owner at any time; and

  • opt out of any “sale” or “sharing” of personal information for advertising where applicable under state law (we also honor Global Privacy Control signals where available).
Submit requests by emailing info@bestofbackyard.com or calling (888) 731-2629.

Continuity of operations during transition. To fulfill pending orders, warranties, and legal obligations, we and our service providers may continue to process your personal information during any transition period.

Bankruptcy or insolvency. If a transfer occurs through bankruptcy or similar proceedings, it will be carried out in accordance with applicable law and any court orders.

Notice of transfer. If a change of ownership results in material changes to how your information is used, we will provide a notice (for example, by posting on our website or sending an email) and explain your options.

YOUR CHOICES

• Emails: unsubscribe any time from marketing emails. You will still receive transactional emails (e.g., order confirmations).
• SMS (if offered): consent is not a condition of purchase. Message/data rates may apply. Reply STOP to opt out, HELP for help.
• Cookies/ads: manage in your browser/device settings; some functionality may be limited.
• Account: update your info in your account or by contacting us.

YOUR PRIVACY RIGHTS (CALIFORNIA AND OTHER U.S. STATES)

Depending on where you live, you may have the right to:
• Access/know the categories and specific pieces of personal information we collected.
• Delete personal information, subject to legal exceptions.
• Correct inaccurate personal information.
• Opt out of “sale” or “sharing” of personal information for cross-context behavioral advertising.
• Limit use/disclosure of sensitive personal information (we do not use sensitive PI in ways that require offering this right).
• Be free from discrimination for exercising your rights.
• Appeal our response to your request (where required by law).

How to exercise your rights: Email info@bestofbackyard.com or call (888) 731-2629. We will verify your identity (for example, by matching information already on file) before acting on a request. You may use an authorized agent; we may require proof of authorization and verification of your identity. To opt out of “sale” or “sharing,” email us with “Do Not Sell or Share” in the subject line. Where available, we honor GPC signals.

California “Shine the Light”: we do not disclose personal information to third parties for their own direct marketing purposes.

FINANCIAL INCENTIVES (DISCOUNTS, COUPONS, EMAIL SIGN-UPS)

From time to time, we may offer benefits such as discounts, coupons, or early access in exchange for providing your email, phone number, or marketing preferences. Participation is voluntary, and you may withdraw at any time. We estimate the value of such incentives based on factors like the expected benefit of the relationship, anticipated revenue, and costs related to the offer. To opt out, unsubscribe from marketing emails or contact us.

CHILDREN’S PRIVACY

Our Services are intended for adults and are not directed to children under 18. We do not knowingly collect personal information from children under 18. If you believe a minor provided personal information, contact us to request deletion.

INTERNATIONAL USERS

We primarily serve U.S. customers. If you access the Services from outside the United States, you understand your information may be processed in the U.S., which may have different data-protection laws than your country.
